E-GASKETS LTD. TERMS AND CONDITIONS OF TRADING
(a) Once you have found the item that you require and have selected this item and added it to your shopping basket you will then need to click on the “Proceed to Checkout” button and complete the order form where you will be required to insert your payment details.
(b) No contract exists between you and us for the sale of any goods until we have received and accepted your order and payment and sent confirmation by e-mail to the e-mail address you have provided. Once we have done so, there is a binding legal contract between us.
(c) If (and only if) you are purchasing goods as a Consumer as such term is defined in the Consumer Protection (Distance Selling) Regulations 2000, the contract is subject to your right of cancellation (see below). Cancellation of orders by consumers can only be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000. Cancellation by business to business customers is not permitted.
(d) E-Gaskets Ltd may change these terms and conditions without notice to you in relation to future sales, and E-Gaskets Ltd is entitled to refuse any order placed by you.
(e) All contracts of sale made by E-Gaskets Ltd shall be deemed to incorporate these terms and conditions, and they shall prevail over any other terms from the party (“the customer”) with whom E-Gaskets Ltd is dealing.
(f) You undertake that all details you provide to us for the purpose of purchasing goods are correct and the credit or debit card used to make the purchase from us is your own card, that there are sufficient funds or credit facilities to cover the costs of any goods or services which you order form us, and that you are authorised to use it. We reserve the right to obtain a validation of your credit or debit card details before providing you with any goods or services.
2. Description of Price of Goods
(a) The description and price of goods you order will be as shown on our website at the time you place your order.
(b) The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
(c) Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order as soon as possible at the correct price or cancelling your order. If cancelled, we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
(d) In addition to the price, you will be required to pay a delivery charge for the goods, as shown in the section of our website about delivery.
(e) The price of goods listed on our website are exclusive of delivery charges. Delivery charges will be shown separately, and will be added to the price at the “checkout”.
(f) The price of goods listed on our website are exclusive of VAT for goods purchased within the UK, and are exclusive of any import taxes, duty or equivalent of VAT, or any other charges, when delivery is to a location outside the UK, and E-Gaskets Ltd. does not accept any liability or responsibility for any payments which may be due, which shall be the customer’s sole responsibility.
(a) Payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order.
(b) Where payment is made via a credit or debit card, payment will be taken on the date of dispatch.
(a) The goods you order will be delivered to the address that you give when you place your order.
(b) If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods. We reserve the right to charge you for any additional delivery costs incurred by us.
(c) Every effort will be made to deliver the goods as soon as possible after your order has been accepted and in any event within 30 days of your order. However, we will not be liable for any loss or damage suffered by you through any reasonable or unadvisable delay in delivery. If we are unable to deliver within the 30 days we will inform you as soon as possible.
(d) You will become the owner of the goods once payment in full has been received by E-Gaskets Ltd. and the goods have been delivered to you.
(e) Unless specifically stated all orders with a weight of up to 1kg within the UK will be delivered by Royal Mail First Class Recorded Delivery. Any orders made weighing more than 1kg within the UK will be delivered by Royal Mail Standard Parcel Service.
(f) Delivery of orders to outside the UK will be by Royal Mail, unless requested otherwise, and will be subject to a separate quotation in respect of the Royal Mail’s delivery charge.
(g) All deliveries made by the Royal Mail will be subject to the terms and conditions of the Royal Mail, which can be viewed at www.royalmail.com.
(h) All delivery charges are to be borne by the customer.
5. Your Rights of Cancellation if you Purchase as a Consumer
(a) This clause 5 applies only if the customer purchases as a Consumer.
(b) You have the right to cancel the contract with us for the goods you order at any time up to the end of the seventh working day from the date that you receive the ordered goods.
(c) To exercise your right of cancellation, you must give written notice to E-Gaskets Ltd. UK by e-mail firstname.lastname@example.org giving the details of the goods ordered including the invoice number and (where appropriate) their delivery.
(d) If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost to E-Gaskets Ltd.’s physical address shown on this website’s opening page.. You must take reasonable care to ensure that the goods are not damaged in the meantime or in transit.
(e) Returned goods must be returned in a saleable condition, being in the same condition as when received by you.
(f) Once you have notified the supplier that you are canceling the contract, the supplier will refund or credit you within 30 days for any sum which has been paid by you or debited from your credit for the goods.
(g) If you do not return the goods as required, we may charge you the sum not exceeding the costs of recovering the goods.
6. Data Protection
(a) We will take all reasonable precautions to keep the details of your order and payment secure but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.
(b) We will only use the information you provide about yourself for the purpose of fulfilling your order unless you agree otherwise. We would like to notify you of products and offers that may be of interest to you from time to time and if you would like to be notified of these, please tick the box below. You can correct any information about you, or ask for any information about you to be deleted, by giving written notice to the e-mail address shown below.
7. Force Majeure
(a) Where, in spite of its reasonable efforts, E-Gaskets Ltd. is unable to perform an obligation due to force majeure, it shall not be deemed to be in breach of its contract with the customer.
8. Applicable Law
(a) These terms and conditions and supply of the goods will be subject to English Law and the English Courts will have jurisdiction in respect of any dispute arising from the contract.
(a) “E-Gaskets Ltd.” means E-Gaskets Limited (a private company registered in England and Wales registered number 5766225), also referred to as “we” and “us” in these terms and conditions.
(b) “the Customer” means you, the paying party to the contract.
(c) “working days” means Monday to Friday, excluding Bank or other Public Holidays.
(d) “Force Majeure” means any cause affecting the performance by us of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.
(e) “Consumer” has the same meaning as defined in the Consumer (Distance Selling) Regulations 2000.
(f) “business” includes trade or profession.
